now lez talk about the patriot act. The real power behind george w. bush was radical republicans called, Neo-conservative, or NeoCon. They existed since 1973 and they finally got the power in 2001.Neocons are hated by democracts and even hated by true conservatives. Their top priority is national insterests. so whenever national interests conflict with other issues like civil liberties and welfare of states, they think its right thing to overrule them.

From that radicalism, the patriot act was born, the Bush doctrine(Pre-emptitive Strike) was born. The Difference between the patriot act and existing federal law is that under the patriot act, the government can extract infromation such as personal records without the consent that inlcudes unauthorized wire-tapping, detain without representation, etc. The bush administration also made it clear that torture on terrorists that are not covered by Geneva convention is legitimate.

Obama has consistently said that he would support a patriot act if 3 basic civil liverties are preserved. Listen. American people overwhelmingly supported afghanistan war in order to catch osama bin laden and its harboring regime, Taliban.

What they didn't like was iraq war. So people still supports war against terrorism and taliban. In oder to do that the patriot act is necessary. but obama's point and democract's point is that you don't need to sacrafice basic civil liberties. Obama said the government can obtain personal records through proper channels such as Administrative Subpeona and national security letter that are subject to judicial review.

He also cosponsored a bill in 2005 called SAFE(Security and Freedom and Enhancement) that act as safeguard against privacy and civil liberty violations that occurs under the patriot act. The bill requires the government to acquire specific warrant with every detail in oder to wiretap citizens.
Obama also joined a filibuster to block bush version of patriot act which heavily strips civil liberties. In US, Filibuters is something that you risk your political life.
